1- GENERAL TERMS & CONDITIONS

Gestion Hotelera Guirado Aras, SL (CIF B53951646), with registered office at Calle Montevideo 16, 03502 Benidorm – Alicante, operates under the trade name KALMARENT for the rental of tourist accommodations.

 

 

TERMS & CONDITIONS APPLICABLE TO ALL APARTMENTS:

 

All guests must comply with the rules of this tourist/vacation rental.

 

  • Any dispute or complaint from neighbors must be reported immediately. A neighbor complaint is grounds for immediate expulsion. Disrespectful behavior toward building or neighborhood residents is strictly prohibited.

  • Each property is governed by its own internal community owner rules, which guests agree to follow. Failure to comply may result in immediate expulsion.

  • Noise must be minimized to avoid disturbing neighbors, especially between 23:00 and 08:00.

  • If check-in or check-out occurs at night, please minimize noise from luggage, shouting, or laughter.

  • Parties or celebrations are not allowed and are grounds for immediate expulsion.

  • Unauthorized overnight guests are not allowed. Economic assessment and prior approval are required. If extra guests are detected without notification, a charge of €50 per person per night applies, deducted from the deposit, and may lead to expulsion.

  • Guests must use facilities properly. Any damage will be deducted from the deposit.

  • Bedding & towels: All apartments include bedding and towels for each guest. No towel or sheet changes during the stay. Apartments have a washing machine for linen cleaning. For stays over 14 nights, one additional set of sheets is provided.

  • Apartments are child-friendly, but guests are responsible for minors’ safety and behavior. Responsibility for children: Avoid ball games indoors, jumping on beds or sofas, damaging walls or furniture, etc.

  • KalmaRent reserves the right of admission. By booking, you accept all these terms and conditions, which will be enforced under a “vivienda turística” contract for stays under 10 nights and a temporary rental contract for stays of 10 nights or more. Both contracts include the WUE clause, requiring good conduct by all guests and compliance with each building’s community rules. Violation will lead to eviction without refund and loss of the full deposit.

 

 

Check‑in Day:

 

✅ The apartment is available from 16:00, possibly delayed until 18:00 in high season (unless otherwise agreed in writing).

 

 

Check‑out Day:

 

✅ The apartment must be vacated by 10:30 (unless otherwise agreed in writing). Late check‑out incurs €30 per extra hour.

✅ Towels: Place used towels on the bathroom floor so we know which remain clean.

✅ The apartment should be free of trash and generally tidy. Any damage or dirt (including linens) requiring special cleaning or repair will be deducted from the deposit. KalmaRent reserves the right to charge €50 if the apartment is not delivered in the stated conditions at check‑out.

✅ Verify all electrical appliances are turned off: lights, air‑conditioning, TVs, etc.

✅ If you have a reserved parking space, leave the remote control inside the apartment after vehicle departure. To avoid having to go upstairs again, the gate can be operated from the terrace.

✅ Deposit return: After check‑out cleaning and inspection, the deposit will be returned within 48–72 hours.

 

 

ADD‑ON SERVICES (Extra Cost):

  • 🚐✈️ Airport transfer: From €75 (Benidorm apartments), from €85 (Altea apartments). Check availability.

  • Late check‑out: Ask for availability and prices.

  • Early check‑in: Ask for availability and prices.

  • Extended stay discount: Check for availability and rates.

  • Door opening (locks locked inside): €25

  • Emergency locksmith (key left in interior lock): Price varies—guest liable. DO NOT leave keys in the lock.

 

 

DAMAGES

 

Guests must report any existing damage on the day of check‑in. KalmaRent has 48 hours to address reported issues.

Otherwise, KalmaRent will charge guests for any damages detected at check‑out, using stored deposit and with authorization. Guests must send photos/description via WhatsApp before maintenance arrives. Access permission is required—if denied, maintenance will notify guest 60 minutes before entry; failure to be present results in a €25 unjustified attendance fee.

 

 

WASTE MANAGEMENT

 

  • Guests must take out trash and not leave waste in common areas.

  • Recyclables (paper, cardboard, plastic, packaging) may be disposed of at any time.

  • Organic waste should be deposited after 21:00.

 

 

ENERGY SAVINGS

 

  • Turn off lights, AC, and appliances when not needed.

  • Do not leave air‑conditioning on when out.

  • Recommended temperatures:

     

    • AC (summer): 23 °C–26 °C

    • Heating (winter): 20 °C–23 °C

    • Underfloor heating (Sunset Waves): 19 °C–20 °C

 

 

TOBACCO & DRUGS 🚭

 

  • Smoking inside is forbidden. A €200 penalty applies if tobacco odor is detected.

  • Drug use in the apartment is grounds for immediate expulsion.

 

 

PETS 🐶🐱⛔

 

Allowed only in Altea Cap Negret by prior request. Inform at booking time with pet details. KalmaRent reserves the right of admission.

 

  • Additional deposit: €200 (if pet accepted)

  • Pet fee:

     

    • Up to 7 nights: €65

    • 8–14 nights: €80

    • 15+ nights: €100

 

 

APPLIANCES & SECURITY

 

  • Do not leave appliances on unattended (blender, kettle, microwave, oven, chargers, etc.).

  • Do not leave children, pets, or valuables unattended.

  • Removing items (chairs, mattresses, towels, linens, etc.) is prohibited.

  • Lost keys/access wristbands: up to €30 per key / €50 per band.

  • Automatic locking: Do not leave keys in interior locks. Locksmith costs are guest’s responsibility.

DAMAGE & LINEN CHARGES

 

Guests must use facilities properly. Damages will be deducted from the deposit. Specific charges include:

  • Small appliances (toaster, kettle, blender, coffee machine, crockery, utensils, etc.): Replacement cost + €30 fee.

  • Large appliances & furniture (fridge, washer, dryer, dishwasher, TVs, sofas, chairs, tables, lamps, shelves, wardrobes, beds, mattresses, etc.): Replacement cost + €60 fee.

 

 

COMPLIANCE

 

Violation of these rules may result in partial or full loss of deposit, immediate expulsion, and liability for damages.

 

 

2. BOOKINGS & PAYMENTS

 

  • Bookings are subject to availability and may be made online or by direct contact.

  • Payment schedule:

     

    • 25% of the total must be paid at least 30 days before arrival (or 60 days for stays over 20 nights or that include summer nights).

    • The remaining 75% is due at least 2 days before check‑in.

  • Cancellations:

     

    • Up to 30 days before arrival: full refund (or 60 days for stays >20 nights or summer).

    • Less than 30 days: 50% penalty (or 60 days rule applies for long/summer stays).

    • Early departures: No refunds for unused nights.

  • Payment methods: Cash (max €1000), credit/debit card, or bank transfer.

 

 

3. SECURITY DEPOSIT

 

A deposit of €200–500 (depending on apartment and number of guests) is required at check‑in. It will be retained until inspection after check‑out and returned within 72 hours if no damage is found.

If damages exceed the deposit, additional charges may be made to the card used for booking.

4. EXCLUSION OF LIABILITY

 

KalmaRent (Gestion Hotelera Guirado Aras, SL, hereafter THE LANDLORD) is expressly exempt from liability in the following cases:

 

  • Misuse of the property by the guest or their invitees.

  • Theft, robbery, or loss of personal belongings within the apartment.

  • Interruptions in utilities (water, electricity, gas, internet) due to external provider issues.

  • Adverse weather, force majeure, natural disasters, pandemics, administrative restrictions, etc.

  • Guest-caused accidents, physical injuries, or damages in common areas.

  • Misuse of appliances or electronic equipment.

  • Damages caused by third parties (neighbors, maintenance personnel, etc.).

 

 

5. DATA PROTECTION

 

In accordance with GDPR and LOPDGDD, we process personal information to provide requested services. Data is retained for the duration of the business relationship and may be shared with third parties as per our Privacy Policy.

KalmaRent provides formal complaint forms for guests.

By signing this contract, the client accepts the full booking price via our website or affiliated partners. In the event of disagreement, parties agree to the jurisdiction of the courts in Benidorm.

  • Breakage: Free replacement upon return of the broken band.

  • Loss: €50 charge per band payable to the Sunset Waves community if lost.

  • Requested availability as street parking is difficult during high season.

     

    • Up to 7 days: €10/day

    • 8–14 days: €9/day
